When a Cambodia Job Ends: Check Work and Immigration Status Separately

Cambodia's Labour Law treats permission to work and permission to reside as related but separate requirements. Article 261 requires a foreign worker to hold a work permit and employment card, to have entered legally, and to possess a valid passport and residence permission. That separation does not prove that immigration status is unaffected when employment ends. It means both records must be checked promptly with the authorities responsible for them.

Start With What The Labour Law Actually Says

Article 261 of Cambodia's Labour Law says that a foreigner may not work without a work permit and employment card issued by the labour authority. It also lists legal entry, a valid passport, and valid residence permission among the conditions for foreign employment. The official text therefore treats work authorisation and immigration status as distinct requirements. Holding one is not evidence that the other is current.

Do Not Turn Separation Into A Guarantee

It is tempting to conclude that because the documents are separate, employment can end without affecting immigration status. The cited Labour Law does not establish that conclusion. It regulates employment, not the full effect of termination on every immigration category. Ask GDI how the current visa or extension is affected and ask MLVT or the employer what must happen to the work permit and employment card.

Check The Documents, Not The Job Title

Collect the passport, current visa or extension, latest entry stamp, work permit, employment card, employment agreement, termination or resignation letter, and recent employer submissions. Record the expiry date and issuing authority for each document. The words business visa or EB in an informal summary are not enough to determine what was granted or what supporting basis was used.

Get The Employer's Record In Writing

Ask the employer to confirm the final working date, the reason employment ended, final payroll arrangements, and what notification or cancellation step it will make with MLVT. Request copies of any filing that concerns the worker. Do not assume that an internal HR update automatically reaches immigration, or that returning company property completes the government process.

Confirm The Immigration Position Promptly

Contact GDI or an appropriately qualified Cambodian adviser with the actual documents. Ask whether the existing status remains usable, whether any notification is required, what deadline applies, and what options are available for the person's intended next activity. We could not verify a universal public grace period, an automatic right to remain until the printed expiry date, or a sponsor-free bridging extension from current official material.

Do Not Work While The New Basis Is Unclear

If a new employer is involved, separate the permission to start work from the permission to remain in Cambodia. Article 261 makes the work-permit and employment-card requirement explicit. A current visa or extension should not be treated as permission to work for a new company. Obtain confirmation that the required employment authorisation is in place before commencing duties.

Moving To A New Employer

The public sources cited here do not establish that a permit transfers automatically, that it must always be reissued, or that one fixed processing time applies. Ask the old employer what it has filed, ask the new employer what it will file, and compare both answers with the current MLVT procedure. Keep the company names, dates, passport details, and employment dates consistent across the documents.

Work-Permit Duration Needs Careful Wording

Article 261 states that the work permit is valid for one year and may be extended, provided the extension does not exceed the fixed period in the person's residence permission. It does not, in the cited passage, say that every permit expires on 31 December or that every renewal is due by 31 March. Those calendar claims should not be published without the applicable current Prakas or MLVT notice.

Labour Rights Are A Separate Review

Termination can raise salary, notice, severance, unused leave, and contract questions under labour law. This article does not determine those rights. Preserve the contract, payslips, attendance records, employer correspondence, and termination notice, and obtain advice from the competent labour authority or a qualified Cambodian employment professional where a dispute exists.

Build A Short, Dated Action Plan

On the first day, preserve the documents and request the employer's written record. Next, contact the relevant authorities or adviser with the real expiry dates and intended next step. Record who gave each answer and when. If a government page, form, or appointment instruction changes, follow the current official process rather than an undated checklist.

Getting It Right

An ending job creates at least two compliance questions: whether the person may continue to work and what happens to the person's immigration status. Review them separately but at the same time.
